Welcome to VitalCare Medical Spa. These Terms & Conditions govern your use of our website, appointment scheduling, communications, services, forms, payment processing, and interactions with VitalCare Medical Spa.

By using our website, booking an appointment, submitting a form, communicating with our team, purchasing services, or receiving treatment, you agree to these Terms & Conditions.


VitalCare Medical Spa provides services in Florida and operates with attention to applicable federal and Florida healthcare requirements, including patient privacy, medical record confidentiality, professional licensing standards, informed consent, and applicable clinic regulations. HIPAA permits healthcare providers to use and disclose protected health information for treatment, payment, and healthcare operations when done according to privacy requirements. Florida law also protects patient records and limits disclosure of medical information except as authorized or required by law.

2. Medical Disclaimer

The information on our website, social media, marketing materials, text messages, emails, educational content, and service descriptions is provided for general informational and educational purposes only.

It is not intended to replace professional medical advice, diagnosis, treatment, emergency care, or evaluation by a licensed healthcare provider.

3. No Guarantee of Results

Consultations
Other aesthetic or medical spa services

Results vary by person. No treatment, procedure, wellness service, IV therapy, weight loss program, skincare treatment, medical tattooing service, or aesthetic service can be guaranteed.

Individual outcomes may depend on age, health history, medical conditions, lifestyle, medications, skin type, immune response, healing ability, treatment compliance, follow-up care, and other factors outside our control.


4. Eligibility for Services

Some services may not be appropriate for every patient. VitalCare Medical Spa reserves the right to refuse, delay, modify, or discontinue services when, in our professional judgment, treatment is not medically appropriate, safe, or within the scope of services available at our clinic.

You may be required to complete intake forms, medical history forms, consent forms, contraindication forms, photo releases, financial agreements, or other documentation before receiving services.

You agree to provide complete, accurate, and honest information regarding your medical history, allergies, medications, pregnancy status, prior procedures, medical conditions, and any other information requested by our team.

Failure to disclose accurate medical information may increase risk and may result in denial or discontinuation of service.


5. Licensed Provider Evaluation and Medical Oversight

Certain services may require evaluation, approval, prescription, standing orders, supervision, or involvement by a licensed medical provider.

VitalCare Medical Spa works within applicable professional standards and Florida healthcare requirements. Florida healthcare records and medical services are subject to confidentiality and professional regulation, including Florida Statute 456.057 regarding medical records and disclosure. 

Receiving information from VitalCare Medical Spa does not automatically establish a provider-patient relationship unless and until you are properly evaluated, accepted for care, and complete all required documentation.


6. Informed Consent

Before receiving certain services, you may be required to sign an informed consent form explaining potential risks, benefits, alternatives, limitations, and aftercare instructions.

Possible risks may include, depending on the service:

Bruising
Swelling
Redness
Pain or discomfort
Bleeding
Infection
Allergic reaction
Unsatisfactory results
Skin irritation
Pigment changes
Scarring
Need for additional sessions
Medical complications
Medication side effects
Adverse reaction to ingredients, prescriptions, injections, or procedures

By receiving services, you acknowledge that you had the opportunity to ask questions and that no result has been guaranteed.


7. Patient Responsibilities

As a patient or client of VitalCare Medical Spa, you agree to:

Provide accurate personal, medical, and billing information.

Follow all pre-treatment and post-treatment instructions.

Notify us of changes in your health, medications, allergies, pregnancy status, or medical conditions.

Arrive on time for appointments.

Treat staff, providers, contractors, and other patients respectfully.

Ask questions before treatment if you do not understand risks, pricing, instructions, or expectations.

Contact us promptly if you experience unusual symptoms, side effects, or concerns after treatment.

Seek emergency care when symptoms are urgent or severe.


8. Appointments, Cancellations, and No-Shows

Appointments are scheduled based on provider availability and service type.

VitalCare Medical Spa may require deposits, consultation fees, booking fees, or prepayment for certain services.

Please provide at least  72 Hours’ notice for cancellations or rescheduling unless otherwise stated in your service agreement, membership agreement, promotion, or booking confirmation.

Late arrivals may result in shortened appointment time, rescheduling, cancellation, loss of deposit or a charge up to $300 US dollar.

No-shows may result in forfeiture of deposit, cancellation fee, or other administrative fee up to $300.00 US dollar

VitalCare Medical Spa reserves the right to update cancellation and no-show policies at any time.


9. Payments, Deposits, and Refunds

Payment is due at the time of service unless otherwise agreed in writing.

VitalCare Medical Spa may accept cash, credit cards, debit cards, financing, insurance payments where applicable, or other approved payment methods.

Deposits, prepaid services, medication-related payments, special orders, customized services, consultations, memberships, packages, and promotional services may be non-refundable unless otherwise required by law or stated in writing.

For services involving prescriptions, compounded medications, medical supplies, special ordering, lab coordination, or provider review, payment may become non-refundable once processing has begun.

Refund decisions are handled on a case-by-case basis and do not guarantee future refunds.


10. Insurance and Reimbursement

VitalCare Medical Spa may accept insurance for certain eligible services, including certain medical micropigmentation or restorative services when applicable.

Insurance coverage is never guaranteed. Benefits, eligibility, deductibles, copays, coinsurance, prior authorization, reimbursement, and claim approval depend on the patient’s insurance plan and payer rules.

Patients are responsible for any amounts not covered by insurance, including denied claims, deductibles, copays, coinsurance, non-covered services, or balance amounts permitted by law.


11. Memberships, Packages, and Promotions

Memberships, service packages, and promotional offers are subject to the specific terms provided at the time of purchase.

Promotions may not be combined unless expressly stated.

Unused services may expire according to the applicable membership, package, or promotional agreement.

VitalCare Medical Spa may modify, pause, discontinue, or replace promotional offers at any time.

For VitalCare Medical Spa memberships, any specific monthly billing commitment, service limitations, transfer rules, no-show rules, or non-rollover terms should be followed according to the signed membership agreement.


12. Weight Loss Services

Weight-loss-related services may require medical evaluation, provider approval, medication review, health screening, prescription coordination, or ongoing monitoring.

Results vary and are not guaranteed.

Patients must follow all medication instructions, storage requirements, dosing instructions, follow-up requirements, dietary guidance, and safety warnings provided by the prescribing provider, pharmacy, or VitalCare Medical Spa.

Patients should immediately seek emergency medical care for severe allergic reaction, difficulty breathing, chest pain, severe abdominal pain, fainting, severe dehydration, or other serious symptoms.

VitalCare Medical Spa does not guarantee availability of any specific medication, compounded medication, brand, pharmacy supply, dosage, or treatment plan.


13. IV Therapy Services

IV therapy and injectable wellness services may involve medical screening and may not be suitable for everyone.

Possible risks include bruising, vein irritation, infiltration, infection, allergic reaction, dizziness, fainting, nausea, fluid overload, medication reaction, or other complications.

Patients must disclose medical conditions, kidney disease, heart conditions, pregnancy, medications, allergies, history of fainting, clotting disorders, or prior reactions before receiving IV therapy.

VitalCare Medical Spa reserves the right to deny IV therapy if it may be unsafe or inappropriate.


14. Medical Tattooing and Micropigmentation Services

Medical tattooing, nipple and areola restoration, scar camouflage, scalp micropigmentation, and related services may require multiple sessions and proper healing time.

Results may vary based on skin type, scar tissue, prior surgery, radiation, immune response, aftercare, lifestyle, sun exposure, pigment retention, and healing ability.

Color changes, fading, asymmetry, touch-ups, and additional appointments may be necessary.

Patients must follow all aftercare instructions and notify VitalCare Medical Spa of any signs of infection, abnormal healing, or complications.


15. Skincare and Aesthetic Services

Skincare and aesthetic treatments may cause temporary redness, sensitivity, peeling, irritation, breakouts, bruising, swelling, or pigment changes.

Patients must disclose the use of retinoids, Accutane/isotretinoin history, acids, exfoliants, steroids, blood thinners, recent procedures, allergies, pregnancy, or medical conditions before treatment.

Sun protection and aftercare compliance are important for safety and results.


16. Before-and-After Photos, Testimonials, and Marketing

VitalCare Medical Spa may take clinical photos for documentation, treatment planning, and progress tracking.

We will not use identifiable photos, videos, testimonials, medical stories, names, or treatment images for advertising, website use, social media, or training unless you provide specific written authorization.

You may refuse marketing photo or testimonial use without affecting your ability to receive services.


17. Website Use

You agree not to misuse the VitalCare Medical Spa website.

You may not:

Attempt to hack, damage, or disrupt the website.

Submit false information.

Copy website content for commercial use without permission.

Use our website to harass, defame, threaten, or abuse others.

Use our forms for spam, fraud, or unauthorized solicitation.

You may opt out of promotional communications at any time. However, we may still contact you for treatment, billing, scheduling, safety, legal, or administrative reasons.

Email and text messages may not be fully secure. Do not send urgent medical concerns or highly sensitive information through unsecured communication channels.

22. Medical Records Requests
